A. Any person found guilty of violating any provision of this code, except as otherwise provided, shall be guilty of a class one misdemeanor, and upon conviction thereof shall be punished by a fine not to exceed two thousand five hundred dollars ($2500) or by imprisonment for a period not to exceed six months, or by a period of probation not to exceed three years, or by any combination thereof. Each day that a violation continues shall be a separate offense punishable as herein described.

B. Any violation of or failure or refusal to do or perform any act required by Chapter 11 of this code constitutes a civil traffic violation. Civil traffic violations are subject to the provisions of Title 28, Chapter 6, Articles 20 and 21, Arizona Revised Statutes and amendments thereto.

C. It shall be a civil infraction for any person, firm, corporation, etc. or any combination thereof to violate, disobey, omit, neglect or refuse to comply with, or to resist enforcement of any provision of the current Oro Valley Zoning Code Revised or Grading Ordinance. All fine amount limits shall be identical to those designated as a petty offense under Arizona state law. The court may order remedial action by the defendant in addition to any fines imposed. The cost of the remedial action may exceed the maximum fine for violation of this ordinance. This is a strict liability ordinance.

If any property or improvement thereon is used in violation of the provisions of the above mentioned codes or ordinances, the Zoning Administrator and/or his designees and/or the Town Engineer and/or his designees, may institute any appropriate action or proceeding by the issuance of a civil citation or summons. The above mentioned individuals may also issue separately or in conjunction with the citation or summons any other administrative order or action that they deem necessary in order to restrain, correct or abate such violations, to prevent the occupancy of such building, structure or land, or to prevent any further work or additional violations arising from further conduct, business or use in or about such premises. Each day that the violation continues shall constitute a separate offense. If the property is platted, each platted lot on which the violation occurs shall also constitute a separate offense. A citation or summons must be issued for each separate offense.

The “Town of Oro Valley Local Rules of Practice and Procedure” shall apply to civil violations of the Oro Valley Zoning Code Revised and Grading Ordinance. If said rules are not adopted by the Arizona Supreme Court, then the “Local Rules of Practice and Procedure of the City Court in the City of Tucson” shall apply to civil violations of the Oro Valley Zoning Code Revised and Grading Ordinance with such changes as may from time to time be adopted by the Oro Valley Magistrate Court. The words “Town of Oro Valley” shall replace the words “City of Tucson” in applying the above Local Rules. ((O)94-18, 08/03/1994; (O)94-17, 08/03/1994)
