This section is included in your selections.

It is unlawful for any person to consume an alcoholic beverage in public, or to be in possession of any open container of an alcoholic beverage in public without a proper permit. For purposes of this section, non-alcoholic beers are included within the definition of alcoholic beverages as they do contain minute traces of alcohol and to aid in the enforcement of this section by avoiding the taking of samples of and analysis of every beverage. “In public” shall include the common areas of apartment complexes in its definition. A person located on their private balcony area of an apartment building is not considered to be “in public”. ((O)02-07, 03/20/2002)
