A. Any dog owned, possessed, harbored, kept or maintained on public streets, sidewalks, alleys, parks or other public property within the Town shall be restrained by a leash, chain, rope, cord or similar device.

B. Any dog owned, possessed, kept, harbored or maintained upon or about the private property of any person, including the property of the dog’s owner, shall be confined inside a house or other building, or confined by a fence or similar enclosure of sufficient strength and height, to prevent the dog from escaping from the property.

C. Exceptions. Dogs accompanied by and under the control of their owners are exempt from this article under the following circumstances:

1. While participating in field trials, dog obedience classes, and/or kennel club events, provided the dog is accompanied by and under the control of the dog’s owner or trainer.

2. While assisting a peace officer engaged in law enforcement duties.

3. Guide dogs while assisting blind, deaf or physically handicapped persons, as long as such dogs are under direct and effective voice control of such individuals to assure that they do not violate any other provisions of this chapter.

D. The Town Enforcement Agent and/or a peace officer are authorized to impound any dog running at large in accordance with the provisions of this article. ((O)08-22, 11/05/2008)
