A. Violations of this article shall be civil infractions punishable as follows:

1. For the first violation within a twelve (12) month period: a fine of no less than twenty-five dollars ($25.00) and no more than two hundred and fifty dollars ($250.00).

2. For the second violation within a twelve (12) month period: a fine of no less than one hundred dollars ($100.00) and no more than two hundred and fifty dollars ($250.00).

3. For the third violation within a twelve (12) month period: a fine of no less than two hundred dollars ($200.00) and no more than two hundred and fifty dollars ($250.00).

B. Any person violating the provisions of this article shall be guilty of a separate offense for each day or portion of a day during which any violation of this article is committed and/or permitted. Any individual who receives notice of such violation and fails to appear at the designated hearing time in the notice, or at the time designated for hearing by the Court, shall be deemed to have admitted the allegations of the complaint and the Court shall enter judgment for the Town and impose civil sanctions in accordance with the provisions of this chapter. If any penalty ordered by the Court to be paid and/or forfeited pursuant to default is not paid within thirty (30) days of the magistrate’s order, the Town Attorney may initiate appropriate civil proceedings to seek legal and/or equitable relief to enforce the order, and the magistrate may initiate judicial proceedings as provided by law to collect the penalty. All penalties collected pursuant to this article shall be paid to and become the property of the Town.

C. In addition to any other penalties allowed by law, the Magistrate shall order abatement as necessary. ((O)08-22, 11/05/2008)
