A. The owner of any animal found to have bitten and/or otherwise injured human beings and/or other animals shall be guilty of a Class One misdemeanor except as provided in Section 18-9-2(E)(6).

B. It is unlawful for any person to fail to comply with an order of a Town Magistrate regarding a biting animal. Such offense is a Class One misdemeanor and it is a separate offense for each day or portion of a day the owner fails to comply with the Magistrate’s order.

C. A violation of this article is punishable with a sentence of imprisonment for up to six (6) months, three (3) years’ probation and/or a two thousand five hundred dollar ($2,500) fine.

D. Misdemeanor Compromise. A violation of this article may be misdemeanor compromised pursuant to the procedures set forth within Arizona Revised Statute § 13-3981. The recommendation of the Town Prosecutor’s Office shall be necessary before such arrangement can be entered into. ((O)08-22, 11/05/2008)
